A per diem job generally describes an employer's as-needed or intermittent staffing arrangement; it does not, by itself, promise a daily rate, regular shifts or a particular benefits package. Read the offer for the actual hourly or daily rate, availability requirements, guaranteed hours, cancellation terms and benefits eligibility. Travel per diem is a separate expense allowance with its own reimbursement and tax rules.
Reviewed November 2, 2026 · U.S. employment-offer review. Employer examples below apply to the named institutions. State law, a collective bargaining agreement and the actual appointment can add requirements. All earnings figures are fictional.
A listing that says “per diem, $38 per hour” tells you a rate but leaves an important question unanswered: how much work will actually be assigned? A higher rate with uncertain hours can produce less weekly income than a lower rate with a stable schedule.
Before accepting, separate the job arrangement from the payment method and any travel allowance. Our offer letter versus employment agreement guide explains why the complete terms matter, while the part-time benefits guide covers eligibility and actual enrollment.
Does per diem mean being paid by the day?
Ask how the employer uses the term. A per diem position can pay by the hour even though the phrase is associated with a day. For example, the University of Washington's current employment policy describes intermittent positions, including per diem roles, as hourly positions involving sporadic work without a particular pattern. That is an identified employer policy, not a nationwide definition.
Three separate facts belong in your review: the appointment type, the pay unit and the scheduling commitment. “Per diem” can describe the appointment; “$38 per hour” describes the unit and rate; a written schedule or minimum-hours commitment describes the work offered.
An employer may require availability for certain weekends or a minimum number of shifts. That availability obligation does not necessarily mean the employer guarantees the same number of assignments. Ask whether each requirement applies to offering availability, accepting a shift or completing paid work.
What should the offer explain?
| Term | Ask the employer | Record to keep |
|---|---|---|
| Pay unit | Is the stated amount hourly, per shift or daily? Which activities are paid? | The approved rate and applicable pay policy |
| Scheduling | Are any hours guaranteed? How far ahead are assignments offered? | The scheduling commitment and work calendar |
| Availability | Must I offer weekends, holidays or a minimum number of shifts? | The actual availability requirement |
| Changes | What happens when a shift is canceled, shortened or extended? | The cancellation, reporting-time and applicable legal rules |
| Additional pay | When do premiums, call-back pay or overtime apply? | The governing policy or agreement |
| Benefits | Which benefits apply now, and what can change eligibility later? | Plan information, eligibility dates and enrollment instructions |
Also identify the employing organization and work location. A staffing agency and a facility can play different roles in scheduling and payroll. Know which organization issues the paycheck and which contact can correct a time record.
Ask about required orientation, training, travel between assignments and on-call obligations. Whether particular time must be paid depends on the actual activity and applicable rules. A job label does not answer those questions; document the employer's instructions and obtain clarification when needed.

A $38 rate does not establish a fixed weekly paycheck
Consider a fictional employee paid $38 for each paid hour. In the first week, two eight-hour shifts produce 16 paid hours and $608 gross wages. In the second week, four eight-hour shifts produce 32 paid hours and $1,216 gross.
The total across the two weeks is 48 hours and $1,824 gross. The arithmetic average is $912 per week, but neither week actually paid that amount. If the employer makes no future-hours commitment, the average is not a guaranteed weekly wage.
| Period | Paid hours | Calculation | Gross wages |
|---|---|---|---|
| Week 1 | 16 | 16 × $38 | $608 |
| Week 2 | 32 | 32 × $38 | $1,216 |
| Two-week total | 48 | $608 + $1,216 | $1,824 |
This illustration assumes straight-time wages only, with no premium, reimbursement or other compensation. It does not calculate net pay. Use actual deductions to estimate the deposit and a conservative schedule assumption when planning bills.

Do not average weeks together to decide whether overtime is owed. The Department of Labor's FLSA guidance generally measures covered nonexempt overtime after 40 hours in a workweek. Special arrangements and state requirements can differ. The two weeks in this illustration remain separate for that check.
Do per diem employees receive benefits?
The label alone does not establish a universal yes or no. Ask about the actual appointment, plan, hours measurement, waiting period and enrollment requirements. A recruiter describing a role as “flexible” has not answered whether you are eligible for health coverage or retirement contributions.
As a specific example, UCSF's per diem benefits page describes eligibility based on appointment conditions or later measured hours. Its thresholds belong to that institution's arrangements. They should not be applied to another employer's workforce.
Request the benefits information before comparing the per diem rate with an existing job. Include your share of premiums, eligibility dates, paid leave and any retirement terms. If your hours fluctuate, ask who monitors continued eligibility and how you are notified of a change.
Does per diem automatically mean independent contractor?
No. The IRS's worker classification guidance considers the facts of the relationship, including control and independence. A staffing label alone does not decide federal tax status. Ask whether the employer is treating the role as employee payroll and which tax documents and withholding setup apply.
If the offer and onboarding documents conflict, resolve that with the hiring organization before signing. Our W-9 versus W-4 guide explains the different purposes of those forms; receiving one is not a substitute for a correct classification review.
Is travel per diem part of the hourly wage?
Travel per diem is an allowance for qualifying business travel expenses. An employer can use a per diem staffing arrangement without providing a travel allowance, or reimburse travel for an employee with a regular schedule.
Under the 2026 IRS employer tax guide, accountable-plan treatment requires a business connection, timely substantiation and return of excess amounts as applicable. Fixed travel allowances have additional substantiation and rate rules. An allowance is not automatically tax-free because payroll calls it per diem, and ordinary wages cannot simply be relabeled as reimbursement.
Ask which costs the allowance covers, whether lodging is arranged separately, which dates qualify and what documentation must be submitted. Keep the reimbursement policy and actual travel records separate from the job's wage-rate agreement. The same bank payment can contain different components without making them all wages.
Clarify the offer before writing an acceptance
Use a short list of unresolved terms rather than assuming the most favorable interpretation. The following is a fictional request for clarification, not a legal employment contract:
Example: clarify scheduling and pay
Thank you for the per diem opportunity. Please confirm that the approved base rate is $38 per paid hour and identify any separate shift premiums.
Does the requirement to provide two available shifts each month guarantee two paid assignments, or does scheduling remain dependent on staffing needs? Please also send the applicable cancellation and benefits-eligibility information.
I would like to review those terms before confirming my acceptance.
An employer can organize its approved terms with the Offer Letter tool. The prepared letter still needs the employer's review and any required policies or agreements. It does not create a benefits entitlement or guarantee hours on its own.
Once the terms are settled, use the job acceptance checklist to confirm the role, start date and agreed details without adding new assumptions.
Check the first statements against actual work
Keep the accepted offer, availability submission, confirmed schedule, time record and first employer-issued statement. Compare the paid hours and rate before interpreting deductions. A missing shift is a different issue from a correctly calculated tax line.
For income documentation, distinguish the stated hourly rate, hours already worked and future assignments. Our gross annual income guide explains why actual earnings and annualized estimates differ. Ask the requesting organization which evidence it needs instead of presenting an uncertain schedule as guaranteed income.
Per diem job questions
Will I always earn more in a per diem job?
No. Compare paid hours, actual premiums, benefit costs and schedule commitments, not just the advertised rate.
Does availability count as a paid shift?
Ask about the actual availability and on-call conditions. Offering dates does not itself establish that an assignment occurred.
Can I use the travel allowance as regular wages?
Keep its actual purpose and tax treatment. A business-expense allowance and compensation for work are separate items.
Can a letter tool settle a scheduling dispute?
No. It can organize approved facts, but it cannot decide what an agreement or applicable law requires.
The Check Stubs Online Editorial Team reviewed current primary employer and government guidance and independently checked the original hourly-pay example.
